After a month of searching, the Punjab police on Monday arrested the main suspect in the motorway rape case, Abid Mulhi, from Faisalabad.
Speaking to the media about his arrest, the IG Punjab, Inam Ghani, said, “It took us a long time to arrest Mulhi because his partner had informed him that his pictures were on TV, after which he fled the house.”
After his arrest, Abid was presented before the anti-terrorism court on Tuesday, from where he was sent to jail for identification. The question now is what will happen next.
Can Abid be publicly hanged?
There has been outrage in various circles over the motorway rape case. According to some people, Abid should be publically hanged, while others believe he should be punished according to the law.
Speaking about the public hanging law in Pakistan, a Supreme Court Advocate, Farhad Ali Shah, said, ‘The jail rules and regulations determine how punishment is to be carried out. Similarly, there are sections within the Anti-Terrorism Act (ATA) under which the ATC judges can decide the punishment method.’
Can Abid be granted bail in this case?
Shah added, “With regard to subsection 2 of section 497(Statutory Provision), bail facility is available under the ATA. Therefore, with the ATA rules, Abid can be granted bail.
While answering a question, if about whether the accused can appeal against the sentence, the advocate said, ‘Since the FIR, in this case, has been registered under the Anti-Terrorism Act and if Abid is convicted under the same law, he can appeal against the punishment in the Lahore High Court. Moreover, the Supreme Court can overturn the decision of the High Court.’
