BREAKING: Peshawar High Court allows surgery for a woman to become a man
Courts in Pakistan have heard cases like this before.
On Thursday, the Peshawar High Court (PHC) granted a young woman permission to change her sex. The court directed the Hayatabad Medical Complex (HMC) administration to facilitate her in undergoing a sex reassignment surgery (SRS) to become a man.
Before the permit, the woman had filed a petition requesting the court to allow the surgery. The petitioner’s lawyer, Saifullah Muhib Kakakhel, argued that it is the woman’s constitutional right to opt for surgery to change her sex as per her desire. He added strength to his argument by stating Section 2 of the Transgender Persons (Protection of Rights) Act, 2018, which permits a woman to change her gender.
Kakakhel, further, shed light on his client’s situation, stating that she was diagnosed with gender dysphoria. This condition arises as a conflict between a person’s internal gender identity and the biological sex assigned to them at birth. He said that his client had always felt and acted like a man, though she looked like a woman, which caused high mental stress. According to Kakakhel, her condition could be treated through sex reassignment surgery (SRS).
A division bench heard the petition filed by the woman regarding gender change. After examining the case in detail and considering the Constitution, the Transgender Rights Act, and other medico-legal aspects, the division bench issued a court order allowing the woman to undergo surgery, Dawn reported.
The bench also ordered the HMC to facilitate the woman and report back on the matter in three months. This report will include details on the sexual status, the possibility of the sex reassignment surgery, risks involved with the operation, the medico-legal aspects to the case, and the facilitation provided to the petitioner by the hospital in this regard.
Courts in Pakistan have heard cases like this before. In 2015, a Kohat resident underwent surgery at a local hospital and successfully transitioned from female to male. The same year, two Chakwal sisters changed their sex following a physical examination in which doctors declared their gender as male. Last year, in Lahore, a 13-year-old girl underwent a gender reassignment surgery and became a boy.
