Supreme Court says bridal gifts are the wife’s property and remain hers

The Supreme Court has restated that the bridal gifts given at the wedding time are the wife’s property and remain hers. According to the Sharia law, these gifts can not be taken away.

The Sharia law states, “A woman has a right to own and dispose of her property. She has a right to retain her income and property both before and after her marriage. A woman can also start a business without the permission of her father or husband and keep and spend what she earns.”

The law also said that men should benefit from what they earn, and women shall benefit from what they earn. A woman’s entitlement to inherit from her parents and husband, the verdict said, is also precisely ordained in the Holy Quran’s fourth chapter.

“A woman also does not require approval to obtain or dispose of property; what she inherits is hers and hers alone. Neither her husband, father, brother, or son has any entitlement to it. The Quran says ‘Do not eat up one another’s property,” said the judgment.

The supreme court also suggested that husbands make wills to provide for their wives. The Holy Quran has stated the woman’s right to enter into contracts and witness contracts in great detail.

The verdict noted with concern that in Pakistan, the Quran’s injunctions are sometimes relegated in favor of retrogressive practices.
