Supreme Court dismisses all objections, orders the authorities to continue removing encroachments along the Karachi nalas

It should be noted that before the hearing the Gujjar nala operation affectees held a demonstration outside the Supreme Court Karachi Registry.

The Gujjar nala is one of the three stormwater drains that are being widened to ensure a smooth flow of rainwater; the other two drains are Mehmoodabad and Orangi nalas. The Sindh government decided to remove encroachments around these drains after the August 2020 urban floods in Karachi.

According to reports, the Supreme Court has asked the authorities to continue the anti-encroachment drive along the stormwater drains in Karachi.

Reports state that the court heard a petition on Monday filed by the Karachi Metropolitan Corporation (KMC) about the demolition of leased houses along the Gujjar nala, Karachi to widen the drain. The bench was headed by Chief Justice Gulzar Ahmed.

During the hearing, the KMC attorney informed the court that operations are being conducted to remove encroachments in coordination with the National Disaster Management Authority.

The Sindh Advocate General said:

The houses along the drains have been illegally leased by different government departments.

The Chief Justice reminded the Advocate General that his government was responsible for it and said:

How could the illegal leases be given? What was the government doing? All this happened under your nose and [you] didn’t know.

It should be noted that before the hearing the Gujjar nala operation affectees held a demonstration outside the Supreme Court Karachi Registry. The counsel of Gujjar nala operation affectees said:

Our houses were leased by the Katchi Abadi Department, KMC, and other bodies.

However, the court dismissed all objections and said:

The operation cannot be stopped. Encroachments will have to be removed in any case.

The hearing ended with the court ruling that all the lease documents were fake. The court rejected the plea to stop the demolition of houses along the Gujjar nala, Karachi.
