A woman has set an incredible milestone after she received her rightful share in inheritance after 46 years.

Zaitoon Bibi scored a fundamental legal victory after the Supreme Court recognised her deserved share in inheritance after 46 years. The court ruled in her favour, after she was deprived of her father’s property by her brothers.

A resident of Dera Ismail Khan, Zaitoon will now inherit the share which her brothers had previously remarked was ‘gifted’ to them decades ago. The decision followed a long legal battle, which she launched after her father’s demise. In a previous judgement, the Peshawar High Court had already ruled in her favour.

Headed by Justice Ijazul Ahsan, the bench heard the petition against the high court’s ruling in Zaitoon Bibi’s favour. During the hearing, the petitioner’s lawyer said that the sisters had gifted their share to the brothers 46 years ago. However, Justice Ijazul Ahsan said that the sisters were underage when they gifted their share in property. He asked how can a younger sister gift the property to the brothers.

Justice Ahsan remarked that why must it always be the sister who is made to gift her share. He added that the contention was ‘bereft’ of any legal status since there was no record. Likewise, Justice Muneeb Akhtar also back the statement, and questioned the legal status of a minor girl gifting away her property.

The SC observed that the deal wasn’t transparent and eventually accepted Zaitoon Bibi’s right to inheritance in her father’s property.
